1. Who is responsible

2. What MarcalBus does
MarcalBus is an intermediary for corporate transport and tourist transfers in Peru. We coordinate services with vehicles from authorized affiliated operators; we do not own a fleet. To carry out your request, the data needed for the service may be shared with the operator providing it.
3. What data we process
- Data you share with us: what you enter in the quote forms on the website (depending on the form: name, company, email, service or route, date, number of passengers, vehicle and message) or what you share with us on WhatsApp. When you submit a form, the data is sent by email to ventas@marcalbus.com through Web3Forms, a form provider that may process the data outside Peru (international transfer). WhatsApp also opens with the same message so you can decide whether to send it. We use this data to answer your quote request and coordinate the service, and we keep it in our mailbox for as long as the handling of the quote lasts. Web3Forms also keeps a copy of each submission on its platform for a limited period (see section 7).
- Browsing data: pages visited, device, browser, language and referral source, collected through cookies and similar technologies.
- Technical server data (such as the IP address) processed by our hosting provider to deliver and protect the site.
Before you accept, the site loads Google Tag Manager and Google may receive usage signals from the page (for example, which page is visited and technical connection data such as the IP address), without any cookies being installed or persistent identifiers being stored on your device (Consent Mode). Measurement and advertising cookies (Google Analytics 4, Google Ads and similar) are only installed after you accept. See the Cookie Policy.
4. What we use your data for
- Answering your enquiries and preparing quotes.
- Coordinating and managing the requested service with affiliated operators.
- Measuring and improving how the website works and what it offers (with your consent).
- Showing and measuring advertising (with your consent).
5. Legal basis
We process your data on the basis of your consent (measurement and advertising cookies, and the message you choose to send us) and the performance of your request for a quote or service. We apply Peru's Personal Data Protection Law No. 29733 and its regulations in force. For users in the European Union and the United Kingdom, GDPR / UK GDPR rights also apply.
6. Third parties and international transfers
- Google (Analytics, Tag Manager and Ads): measurement and advertising, only with consent.
- Microsoft Clarity: site usage analysis (heatmaps and session recordings), only with consent.
- Vercel: hosting and delivery of the website.
- Web3Forms: form service provider; it processes the data you submit in the forms and delivers it by email to ventas@marcalbus.com. It keeps a copy of submissions on its platform (hosted on Amazon Web Services, with Cloudflare and Hetzner infrastructure) and uses anti-spam services (CleanTalk and Akismet) that receive the sender's IP address and email. It operates from India and may process data outside Peru (international transfer). It acts as a data processor on behalf of MarcalBus.
- WhatsApp / Meta: once you start a chat, the conversation is governed by their own terms and privacy policy.
- Affiliated operators: receive the data needed to provide the service you requested.
Some of these providers are located outside Peru (for example, in the United States). By accepting cookies or messaging us on WhatsApp, you understand that your data may be transferred internationally with the safeguards each provider offers.
7. How long we keep your data
Form submissions that Web3Forms stores on its platform are deleted automatically three months (90 days) after they are received.
We keep conversations and quote data for as long as needed to handle your request and, afterwards, for the periods required by legal, accounting or claims-defence obligations. Cookies last as long as stated in the Cookie Policy. That lifespan is separate from the retention of data in Google Analytics 4, which is 14 months.
8. Security
We apply reasonable technical and organizational measures to protect your data. The site is served over an encrypted connection (HTTPS). No system is infallible; we recommend not including sensitive data in your messages.
9. Your rights and how to exercise them
You may exercise your rights of access, rectification, cancellation / erasure, objection and portability, and withdraw your consent at any time, by writing to us on WhatsApp at +51 928 672 932 or at ventas@marcalbus.com, stating your name and the right you wish to exercise. We may ask for information to verify your identity.
We will reply within the applicable legal deadlines: at most 20 business days and, for GDPR / UK GDPR requests, within one month. If you believe we have not handled your request properly, you may contact Peru's National Authority for Personal Data Protection or, if you live in the EU or the UK, your local supervisory authority.
10. Minors
Our services are aimed at businesses and adults. We do not knowingly collect data from minors.
11. Changes to this policy
We may update this policy when our services or the regulations change. The date of the latest update appears at the top of the page.
